Mr. Manish Kumar, learned GP 4 appearing for the State informs that the matter relates to encroachment over a public land ad-measuring 1.62 decimals in Mauza- Manjha, Block Mohiuddin Nagar, District Samastipur. He further submits that the concerned authorities under the Public Land Encroachment Act i.e., Circle Officer, respondent no. 5 having taken note of the complaint, has initiated the encroachment proceeding giving rise to Encroachment Case no. 2 of 2018.

In such view of the matter and since there is none to contest this position, we dispose of this writ petition with a direction to the Circle Officer, respondent no. 5 to take the

Patna High Court CWJC No.5426 of 2018 dt.19-07-2019 2/2 encroachment case so registered to its conclusion in accordance with law with due opportunity of hearing to the complainant as well as the alleged encroachers who are actually 20 in number as informed by Mr. Manish Kumar learned GP 4 appearing for the State.
