Mr. Sharma seeks permission to withdraw the application with respect to petitioner No. 1, namely, Sonu Kumar @ Sonu Yadav, who has been arrested during the pendency of this bail application and has also been granted

Patna High Court CR. MISC. No.18483 of 2021(2) dt.11-03-2022 2/3 bail by the learned Court below.

Permission is granted.

The application with respect to petitioner No. 1 is, accordingly, dismissed as withdrawn as having become infructuous.

The petitioner No. 2, namely, Bhim Yadav, seeks bail in anticipation of his arrest in connection with Bihta P.S. Case No. 518 of 2020, dated 17.07.2020, instituted for the offences under Sections 341, 323, 324, 307, 379, 504, 325 and 34 of the Indian Penal Code.

The accusation against him is general and omnibus and the occurrence arose out of a very small dispute which was blown out of proportions.

It has been submitted on behalf of the petitioner No. 2 that the injuries suffered by the victims are all simple in nature.

The petitioner No. 2 does not have criminal record. Regard being had to the facts afore-stated, the petitioner No. 2, namely, Bhim Yadav, in the event of his arrest or surrender before the learned Court below within a

No.18483 of 2021(2) dt.11-03-2022 3/3 period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Chief Judicial Magistrate, Danapur in connection with Bihta P.S. Case No. 518 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
