The petitioner has prayed for bail in a case registered for the offence punishable under sections 419, 420, 467, 468, 471, 120B/34 of the Indian Penal Code.
Prosecution case relates to recovery of mobiles, ATM Card and Pass book from the possession of co-accused Santu Ram and on interrogation, he disclosed the name of the petitioner has of his associates. Accused persons are involved in cyber crime in the name of granting loan and used to cheat money from people.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Specific allegation is against co-accused Santu Ram and he was
Patna High Court CR. MISC. No.10492 of 2023(2) dt.25-02-2023 2/2 apprehended on spot and in his confessional statement, name of the petitioner sprang up in this case. Petitioner was neither arrested on spot nor any incriminating article has been recovered from his possession. Similarly situated other accused has already been granted bail vide order dated 15.07.2022 passed in Cr. Misc. No. 30074 of 2022 by different Bench of this Court. Petitioner is languishing in judicial custody since 15.10.2022.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Sheikhpura in connection with Sheikhopur Sarai P.S. Case No. 140 of 2021.
