2. The petitioner seeks regular bail in connection with S.T. No. 46 of 2021 arising out of Barauli P.S. Case No. 249 of 2021 registered on 29.08.2021 lodged under Sections 399/402 of the I.P.C. and 25(1-b)a/26/35 of the Arms Act and Section 20/22.25/29 of NDPS Act which has been rejected vide order dated 23.08.2022 in Cr. Misc. No. 24484 of 2022 with liberty that he may renew his prayer for bail one year after framing of charge.
3. Counsel further submits that petitioner is in custody since 08.09.2021 having ten antecedents. Counsel further submits that one year has been lapsed and almost all the accused
Patna High Court CR. MISC. No.10570 of 2024(3) dt.19-04-2024 2/2 persons have been granted bail.
4. Learned counsel for the State opposes to prayer for bail and submits that antecedent of the petitioner is not clean. He further submits that on earlier occasion progress report has been called for.
5. Upon perusal of the progress report, it transpires that trial is likely to be concluded in a short period of 8 months, as such, this Court is not inclined to grant bail to the petitioner at present.
6. With this observation, the bail application stands rejected.
