====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-02-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Nabinagar P.S. Case No. 280 of 2018, instituted for the offence under Section(s) 420, 467, 468 and 471 of the Indian Penal Code. The prosecution case is that informant and his brother have purchased a piece of land as mentioned in the written report. During course of proceeding initiated under Section 144 Cr. P.C., the petitioner produced fake sale deeds illegally executed by Raman Singh with respect to the aforesaid land in his favour. It is further alleged that such sale deeds were brought into existence with intention to grab the land of the informant.
Counsel for the petitioner submits that petitioner is
Patna High Court Cr.Misc. No.9161 of 2019(2) dt.18-02-2019 2/2 not making claim over the aforesaid land on the basis of forged sale deeds.
Petitioner is in custody since 24.11.2018.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S. Case No. 280 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
