JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-01-2022 Heard Mr. Arun Kumar Tiwary, learned Advocate for the petitioner and Mr. Anil Kumar Chaudhary, learned Advocate for the opposite party no.2. The state is represented by Additional Public Prosecutor for the State.
The petitioner who is the father-in-law of the opposite party no.2 seeks bail in anticipation of his arrest in connection with Mansi P. S. Case No. 263 of 2020 instituted for the offences under Sections 341, 323, 504, 506 and 498A/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
It has been submitted on behalf of the petitioner that though the accusations have been levelled in the F.I.R. against

No.19591 of 2021(2) dt.11-01-2022 2/3 him also, but it is only by way of retaliation against the entire family members of the husband of opposite party no.2 with whom she could not live well as his wife. The petitioner is always ready to offer his advice and his intervention in the matter for getting the matrimonial dispute of his son and daughter-in-law settled.
Learned counsel has further submitted that all other accused persons of this case including the husband of the opposite party no.2 have been granted anticipatory bail by different Benches of this Court.
Learned counsel for the informant on the other hand has submitted that the petitioner has special responsibility as the senior most member of the family to ensure that a woman married in the family is not put to such distress. However, considering the fact that the husband of the opposite party no.2 and another accused persons have been granted anticipatory bail and there is no specific allegation against the petitioner, he is directed to be released on bail, in the event of his/her arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his/her furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two
Patna High Court CR. MISC. No.19591 of 2021(2) dt.11-01-2022 3/3 sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Mansi P. S. Case No. 263 of 2020, subject to the condition as laid down under Section 438
(2) Cr. P.C.
