JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302, 201/34 of Indian Penal Code.

An FIR was lodged on recovery of dead body of one Prabhakar Kumar. Two persons are suspected to be involved in the murder of the deceased. Petitioner was informant of the instant case.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. During course of investigation the only material that has come against this petitioner is that she had illicit relationship with one Praful Kumar, to which the deceased used to object,

Patna High Court CR. MISC. No.7584 of 2022(3) dt.14-11-2022 2/2 became the reason for his death. Except this there is no indirect or direct material against the petitioner. Petitioner is lady and has got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of her arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XII-cum-Sub-Judge IV, Muzaffarpur in Sakra P. S. Case No. 266 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
