The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code and under different sections of the Arms Act.

The informant alleged that he was going along with his brother Shambhu Singh for renewal of licence of rifle and when they reached near Rajlaxmi printing press seven named accused persons including the petitioner and one unknown person surrounded the informant and his brother. Guddu Singh is said to have fired which hit his brother Shambhu Singh. Shambhu Singh died on the spot.

It is submitted that of course the petitioner is named in the FIR but no specific allegation is made against him.

Patna High Court Cr.Misc. No.44973 of 2015 (2) dt.24-09-2015 2/2 Similarly situated accused Suraj Singh has already been enlarged on bail.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in Gogri P.S. Case No. 70/2015.
