JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 18-07-2018 Petitioner, a resident of Village Jamalpur, BlockSubhai, Police Station- Sadar, District- Hajipur, has approached this Court with a grievance that the benefit under the Integrated Child Development Scheme (ICDS) to the children in the
Patna High Court CWJC No.15748 of 2017 dt.18-07-2018 2/3 village in question have not been granted and claiming to be beneficiaries of the scheme many villagers have represented to the District Magistrate, as is evident from Annexure 2 Series indicating that children are not getting the benefit of the scheme in question.
Taking note of the fact that the only grievance of the petitioner is with regard to non-grant of benefit under the Scheme to a majority of the persons belonging to a particular community, as is detailed in Paragraph 3 of the writ petition, we deem it appropriate to direct Respondent No. 3 the Director (ICDS), Patna to look into the grievance of the petitioner and issue necessary directions to the implementing agencies in the district level to ensure that the children and beneficiaries in the village in question receive the benefit. The Director shall ensure implementation of the scheme in the village in question within a period of two months from the date of receipt of certified copy of this order and submit a report to the Registrar General of this Court with regard to the action taken by him. In case the report is not submitted by the Director to the Registrar General of this Court within two months from the date of receipt of certified copy of this order, the Registrar General shall place the matter for consideration before this Court and this Court may consider
Patna High Court CWJC No.15748 of 2017 dt.18-07-2018 3/3 taking action against the Director for not implementing the orders of this Court.
With the aforesaid, the writ petition stands disposed of.
