ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 22.06.2015 in connection with Shahpur P.S. Case No. 57 of 2015, registered for offences punishable under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that earlier the petitioner was arrested in connection with one similar case being Buxar Town P.S. Case no. 103 of 2015. In the said case the petitioner was made to give a confessional statement before the police and it is submitted that on the basis of the said confessional statement before the police, the petitioner has also been remanded

Patna High Court Cr.Misc. No.45388 of 2015 (3) dt.09-02-2016 2/3 in connection with the present case stating that certain recoveries were made from his possession. Learned counsel for the petitioner further submits that five vehicles were recovered from his possession but since he is a motorcycle mechanic, it is very usual that several persons come to him for repair of their motorcycles. He further submits that out of the said five recoveries, two motorcycles were said to be the stolen ones, whereas, the other three motorcycles said to be recovered, were those which had been given to him for repair work by unknown persons. It is further submitted that be that as it may, the petitioner has been granted the regular bail in connection with Buxar Town P.S. Case No. 103 of 2015, by this Court vide order dated 07.07.

2015, in Criminal Miscellaneous No. 20979 of 2015. It is further submitted that in another case bearing Shahpur P.S. Case No. 45 of 2015, the name of the petitioner was roped in and in the said case also, the petitioner has been granted regular bail by this Court vide order dated 01.10.2015, in Criminal Miscellaneous No. 45707 of 2015.

Patna High Court Cr.Misc. No.45388 of 2015 (3) dt.09-02-2016 3/3 petitioner has surfaced only on the basis of confessional statement made before the police, which has no evidentiary value, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri. Raghubir Prasad, learned Judicial Magistrate Ist Class, Bhojpur at Ara, in connection with Shahpur P.S. Case No. 57 of 2015. .
