1. Though, the present writ petition has been filed for staying implementation of the order contained in notice dated 01.06.2022, issued in connection with Encroachment Case
Patna High Court CWJC No.1664 of 2024(3) dt.11-11-2024 2/2 No.06 of 2021-22, by the Circle Officer, Kako, DistrictJehanabad, till the disposal of civil miscellaneous appeal filed by the petitioners, however, at the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to prosecute the title suit already filed by them, bearing Title Suit No.160 of 2022, which is pending consideration before the Ld. Court of Munsif, Jehanabad, nonetheless, seeks some protection during the interregnum period. Liberty so sought is granted.
2. It is needless to state that status quo, existing as on today qua the land/houses of the petitioners in question shall be maintained, for a period of four weeks from today, in order to enable the petitioners to obtain interim orders in the pending suit.
3. The writ petition stands disposed off on the aforesaid terms.
