1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 22.08.2021 in the night some unknown criminals committed theft of three diesel pump sets and one Dhananjay Kumar was apprehended based on whose confession the diesel pump sets were recovered and the name of the petitioner also transpired in the confessional statement of Dhananjay Kumar.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that confessional statement in
Patna High Court CR. MISC. No.9848 of 2026(3) dt.31-03-2026 2/2 police custody does not have any evidentiary value in the eye of law. It is next submitted that similarly situated co-accused, namely, Ravi Kumar has been granted the privilege of anticipatory bail by an order dated 17.02.2024 in Cr. Misc. No. 5543 of 2024 passed by a learned Coordinate Bench of this Court.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner, above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/Successor Court in connection with Guraru P.S. Case No. 103 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C./482(2) of the B.N.S.S.
