====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 07-03-2025

1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 85, 109, 352, 115(2), 127(2) and 3(5) of the BNS as well as Sections 3 and 4 of the Dowry Prohibition Act.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that she was married to Raviranjan Kumar in the year 2018 and after marriage, the accused persons started torturing the informant for dowry. Further, on 20.08.2024, accused Nawlesh Sharma, Rishiraj Sharma and Kunti Devi came and started assaulting the informant while the petitioners i.e. her in-

Further, Nawlesh, Rishiraj and Kunti poured kerosene oil on the informant and alighted the fire but her husband doused the fire and thereafter she was taken to the hospital for treatment.

4. Learned counsel for the petitioners submits that petitioners, being the in-laws of the informant, have been falsely implicated in the instant case. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no overt act has been alleged against the petitioners, though the informant alleges that they were standing at the gate and were not allowing anyone to enter the house. It is next submitted that the said allegation is exaggerated. It is also submitted that no doubt, the informant suffered burn injury but the said burn injury was suffered on account of the fact that her saree caught fire while making food. It is submitted that husband is not an accused in the instant case but then the parents of her husband have been made an accused. The reason is obvious as they are having issues relating to property.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned
