The petitioner seeks regular bail in connection with Athmalgola PS case no. 182 of 2018 registered for the offence punishable under Section 392 of Indian Penal Code. The allegation is regarding unknown accused persons having apprehended the informant on the National Highway and committed loot.

The learned counsel for the petitioner submits that neither any recovery has been made from the conscious possession of the petitioner nor any test identification parade has been held so as to connect the petitioner with the alleged crime. It is further submitted that though the petitioner is an accused in two other cases but he is on bail in both the cases.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Barh, Patna in connection with Athmalgola PS case no. 182 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
