The petitioner is in custody in connection with Barachatti P.S. Case No. 432 of 2019 for the offence under Sections 376, 379, 323, 504, 506/34 of the Indian Penal Code and Sections 4/6 of the POCSO Act, 2012.

Learned counsel for the petitioner submits that there is delay in lodging the F.I.R. and, therefore, the petitioner deserves bail as the case appears to be concocted one. The petitioner is in custody since 18.09.2019.

In this case, case diary was called for.

From perusal of the case diary, the Court finds that there are certain materials available against the petitioner and, as such, the Court is not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail is rejected.

Patna High Court CR. MISC. No.5787 of 2020(4) dt.02-07-2020 2/2 The trial court is directed to conclude the trial within a period of nine months. However, if, the trial is not concluded within the aforesaid period, the petitioner shall be at liberty to renew his prayer for bail.
