JUSTICE JYOTI SARAN ORAL ORDER 04-02-2015 Heard Mr. Bijay Bhushan Prasad, learned counsel for the petitioner and learned counsel for the State. The petitioner is in custody in connection with Madhubani Town P.S. Case No. 264 of 2012 for offence punishable under Sections 379 and subsequently Section 411 of the Indian Panel Code was added to the allegations. Mr. Prasad, learned counsel for the petitioner with reference to the FIR submits that the allegation charges unknown offenders of committing theft of the motorcycle of the informant. He submits that during course of investigation the motorcycle was recovered from the possession of co-accused Ajay Sah. It is stated that on the basis of confessional statement made by co-accused Ajay Sah that the name of the petitioner transpired in the present
Patna High Court Cr.Misc. No.44417 of 2014 (2) dt.04-02-2015 proceedings with no other materials available on record. He further submits that co-accused Ajay Sah has been granted bail by this Court in Criminal Misc. No. 45660 of 2013 and another accused who was similarly arrested on the basis of confessional statement of co-accused Ajay Sah, namely, Bablu Kumar Ram has also been released on bail vide Criminal Misc. No. 5097 of 2014. Having heard learned counsel for the parties and taking note of the submissions of learned counsel, let the petitioner Ranjeet Kumar Yadav @ Raja be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S. Case No. 264 of 2012.
