JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 02-04-2018 Grievance of the petitioner in this writ petition is that in spite of orders passed on 8.11.2016 in C.W.J.C. No.2407 of 2016 (Vikash Chandra Guddu Baba vs. The State of Bihar and others) the post of nursing Tutor in the various course have not been filled up. Seeking a mandamus again to fill up the post, the writ petition has been filed in public interest. We are informed that the petitioner in C.W.J.C. No.2407 of 2016 has already initiated contempt proceedings in M.J.C. No.733 of 2018 (Vikash Chandra Guddu Baba vs. Sri Ajay Kumar Sing and others) complaining disobedience of an order dated 8.11.2016 in the said writ petition.

Keeping in view the aforesaid, a writ petition again

Patna High Court CWJC No.5444 of 2018 (2) dt.02-04-2018 2/2 for the same relief is not warranted when M.J.C. No.733 of 2018 is already pending.

Granting liberty to the petitioner to file an appropriate application and seek intervention in M.J.C. No.733 of 2018, we dispose of the present petition.

M.J.C. No.733 of 2018 be listed for orders before the appropriate Bench in the next week.
