JUSTICE VIKASH JAIN ORAL ORDER 30-01-2019 The present petition has been filed for modification of the order dated 03.01.2019 passed in Cr. Misc. No. 66339 of 2018 by which provisional anticipatory bail has been granted to the petitioner for which one of the conditions as follows - "(i) That provisional anticipatory bail granted to the petitioner shall stand confirmed subject to the condition that the petitioner deposits the amount of Rs. 54,599/- before the North Bihar Power Distribution Company Limited within a period of three months in three equal monthly instalments, the first shall be deposited not later than by 15th January, 2019."

2. Learned counsel for the petitioner submits that 14/15th January, 2019 fell on Makar Sankranti in view of which the petitioner was unable to make deposit of the first instalment within the stipulated date of 15th January, 2019. Such payment

Patna High Court Cr.Misc. No.5313 of 2019(2) dt.30-01-2019 2/2 was made the very next day on 16th January, 2019.

3. Having regard to the submissions of the petitioner, let para-4(i) of the order dated 03.01.2019 be treated as modified to the extent that the last date for deposit of the first instalment be treated as 16.01.2019 in place of 15th January, 2019.
