2. The petitioner is apprehending his arrest in connection with Patliputra P.S. Case No. 54 of 2005 for the offence under section 386 of the I.P.C. lodged on 30.04.2005 by the informant, Uday Kant.

3. As per the prosecution story, the informant alleged that while he was sitting in his shop, the accused persons came and demanded cold drinks. Later, they abused and assaulted causing injuries on his head and cheek. As the locals gathered, they escaped. One of the accused persons dropped his mobile phone whereafter, the same was picked up that followed the

4. Learned counsel for the petitioner tried to impress upon this Court that he is not named in the FIR, the car that was used in the crime, does not belong to him.

5. The matter is of the year 2005 and subsequently, the petitioner approached the Court of learned Session Judge for grant of anticipatory bail, the same was disposed of on 2011 itself. However, for the last 13 years, he sat over the matter and now, again has preferred the anticipatory bail.

6. Considering the nature of crime as also the attitude of the petitioner in sitting over the matter for nineteen years, this Court has no option but to reject his anticipatory bail.

7. The anticipatory bail application stands rejected.

8. Before parting, this Court would like to put on record its word of appreciation for Mr. Anand Kumar Tiwari and Mr. Harshit Ranjan, learned counsels for the petitioner for the proper assistance rendered in the matter. (Rajiv Roy, J) kiran/- U T
