JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409, 409, 420/34 of the Indian Penal Code and the Immoral Traffic (Prevention) Act, 1956.
The prosecution case is on secret information that in Vijay Laxmi Utsava Palace and Residential Hotel flesh trading is going a raid was laid where a boy and a girl were found in objectionable condition. The petitioner was the manager of the Vijay Laxmi Utsava Palace and Residential Hotel. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. There is nothing to suggest that the flesh trade was going on at the
Patna High Court Cr.Misc. No.43941 of 2015 (3) dt.29-10-2015 2/2 behest of the petitioner. Moreover, A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM, 1st Class, Muzaffarpur in connection with Brahmpura P.S. Case No.151 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
