This writ application appears to be wholly misconceived and premature application inasmuch as it appears that the petitioner has moved in its writ jurisdiction only on receipt of the notice dated 04.01.2019 which is nothing but a demand to the petitioner against the price of the rice which were lifted by the petitioner and value of which were required to be deposited by him.

Learned counsel for the State is present and has no objection of disposal of this writ application on the basis of materials available on record.

If the petitioner has to raise any grievance against the

Patna High Court CWJC No.4163 of 2019(2) dt.11-07-2019 2/2 said demand he may do so by filing an appropriate representation/explanation before the Block Development Officer, Sheikhpur Sarai, Sheikhpura within a period of 30 days from today or in case a certificate proceeding has already been filed, he will have an opportunity to submit a show cause contesting the demand which will be considered by the authorities concerned.

In case a certificate proceeding has not been initiated till date, before initiation of the certificate proceeding the representation of the petitioner shall be considered and an appropriate order thereon shall be passed within 30 days from the date of submission of the representation.
