The petitioner is in custody since 14. 08. 2014 in a case registered for the offence punishable under Sections 302/34 and 120(B) of the Indian Penal Code.
Allegation against the petitioner is that he along with other co-accused armed with fire arms came and one Rajiv Kumar shot fire which has caused injury on the informant and his father. Thereafter, all the remaining co-accused also shot fire. It is submitted that no overt act has been alleged against the petitioner either in the statement of the informant or in the statement of any independent witness. After investigation, charge sheet has been submitted.
Considering the facts and circumstances of this case, the
Patna High Court Cr.Misc. No.42945 of 2014 (3) dt.22-01-2015 above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur, in connection with Kalyanpur Case No.184 of 2014, with the following conditions :
1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
