For the Petitioner/s : Mr. Umesh Chandra Verma For the Opposite Party/s : Mr. P.K.Chaurasiya(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The daughter-in-law of the informant was found missing on 27-12-2014 for which, the informant gave a Sanha on 19-012015 but near about three months after the occurrence, i.e. 09-032015, the informant as well as father of the victim gave a joint petition to officer-in-charge of Chhatauni Police Station. It appears from perusal of paragraph-99 of the case diary that in course of investigation, not a single witness claimed to have seen the petitioner, taking away the victim and furthermore, it appears that except criminal antecedent of the petitioner, there is no cogent evidence against him.

Patna High Court Cr.Misc. No.44525 of 2015 (3) dt.18-01-2016 2/2 Submission on behalf of the petitioner is that the petitioner had given evidence against father of the victim in a Title Suit and that is the reason of false implication of the petitioner in the alleged crime.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chhatauni P.S. Case No. 52 of 2015 to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari. (Hemant Kumar Srivastava, J) A.K.V./- U T
