The petitioner is languishing in jail since 01.08.2015 in a case instituted under Sections 7, 13(2) read with Section 13(1)(D) of the Prevention of Corruption Act. As per prosecution case, it is a case of palm greasing whereunder the petitioner has been caught red handed with the bribed money and was arrested on the spot.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.08.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has got no criminal antecedent. Petitioner is a Sub-Inspector of Police.
Patna High Court Cr.Misc. No.44446 of 2015 (4) dt.18-12-2015 As per the allegation, he has been trapped while taking Rs.10,000/- as bribe. It is further submitted that the petitioner may be released after completion of six months in custody from 01.08.2015.
On behalf of the State and counsel for the Vigilance, it has been submitted that the petitioner is named in the FIR and there is direct allegation against him.
Considering the aforesaid facts and circumstances, it is directed that the petitioner be released after completion of six months in custody from 01.08.2015 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction learned Special Judge, Vigilance, North Bihar, Muzaffarpur in connection with Special Case No.27 of 2015 arising out of Vigilance P.S.
