====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-02-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Mohanpur P. S. Case No. 69 of 2025 registered for the offences punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita.
3. As per F.I.R., this petitioner along with other accused persons assaulted husband of the informant by means of lathi, danda as a result of which, he died during course of treatment.
4. Learned counsel for the petitioner submits that as per F.I.R., this petitioner along with co-accused Khushabu Devi and Chunaku Devi assaulted the deceased but in post-mortem report, cause of death of the deceased has not been asserted and
Patna High Court CR. MISC. No.7438 of 2026(2) dt.16-02-2026 2/2 doctor has preserved the parts of vital organs and sent them to FSL department to ascertain cause of death. Co-accused Khushabu Devi has already been granted regular bail by coordinate Bench of this court vide order dated 17.09.2025 passed in Cr. Misc. No. 64663 of 2025. Petitioner claims clean antecedent and is in custody since 02.12.2025.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, materials available on record, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Mohanpur P.
