In this case, the petitioners are seeking anticipatory bail in connection with Barharia P.S. Case No.363 of 2018, registered for the offence punishable under Sections 341, 323, 308, 504, 506/34 of the Indian Penal Code.
The dispute arose on account of filling of soil. The informant and the petitioners are agnates. Allegation has been made against petitioner no.1 to have started altercation with the informant and also abuses him. When the informant prevented him, he started assaulting and threw the informant on the
Patna High Court Cr.Misc. No.9301 of 2019(2) dt.18-02-2019 2/2 ground. Main allegation has been made against one Ishu Singh, who has caused injury by iron rod. Allegation has been made against petitioner no.3 to have assaulted with brick. Considering the entire facts and circumstances of the case, let the above-named petitioners, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Barharia P.S. Case No.363 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
