JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 07-10-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in connection with Sessions Trial No. 378/2014 arising out of Karakat P.S. Case No. 242 of 2013 registered under Sections 302 read with 34 of the Indian Penal Code.

The prayer for bail of the petitioners was earlier rejected by this Court on merits vide order dated 21.07.2014. It is contended that though the petitioners are in custody since 27th November, 2013, till date only two witnesses

Patna High Court Cr.Misc. No.44646 of 2015 (2) dt.07-10-2015 2 / 2 could be examined on behalf of the prosecution. Be that as it may, regard being had to the serious nature of allegation, I am not inclined to grant bail to the petitioners for the present.

The trial court is directed to hold the trial of the petitioners on day-to-day basis and conclude the same as early as possible, preferably within nine months from today failing which the petitioners would be at liberty to renew their prayer for bail before the trial court itself.
