The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 56(c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, three vehicles were intercepted and on checking a total of 2301.12 litres of liquor was recovered.

It is submitted by learned counsel for the petitioner that from the contents of the FIR together with the seizure list it would transpire that 15.75 litres of liquor is alleged to have been recovered from the vehicle in which the petitioner was present. The petitioner has been falsely implicated in the case. He is in custody since 11.1.2022 and has no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Fatuha P.S. Case no. 31 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna City, Patna.

Liberty is granted to the State to file an application for cancellation of bail in case it is discovered that the petitioner had any criminal antecedent and in case such an application is filed, the learned trial Court may proceed to cancel the bail bond of the petitioner.
