JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 Petitioner seeks regular bail in connection with Barauni P.S. Case No. 532 of 2019 registered for the offence(s) punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Allegation is that there is a recovery of 78 liters of liquor and it is said to be of petitioner. He is accused in one more case also.
Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession or from his house. He has falsely been implicated in this case and is in custody since 06.01.2020. He is ready to cooperate in the investigation.
Heard learned A.P.P. also.
Having heard both sides, in view of the submissions,
Patna High Court CR. MISC. No.6998 of 2020(2) dt.06-02-2020 2/2 made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise Act, Begusarai, in connection with Barauni P. S. Case No. 532 of 2019, subject to the condition that he has to cooperate in the investigation.
