Petitioner seeks regular bail in connection with Natwar PS Case No. 171 / 2022 dated 11-11-2022 registered under Section 22(a), 27 of the N.D.P.S. Act.

As per the prosecution story Police on the basis of secret information raided the stove repair shop of the petitioner and recovered 01 ample of 02 ml of BUPRENORPHINE INJECTION I.P.T. GESIC and 01 ample of 02 ml PHENIRAMINE MALEATE INJECTION I.P. and some needles to be used for injection.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case with oblique motive inasmuch as the injections which have been recovered are anti - allergic and pain reliever and the same were kept in his

Patna High Court CR. MISC. No.7718 of 2023(2) dt.10-05-2023 2/2 shop for his personal use. He further submits that similarly situated accused person- Sonu Kumar has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 8945 / 2023. The petitioner is in custody since 12/11/2022. Regard being had to the submission made by the parties, taking into consideration the material on record, the fact that similarly situated accused person has been granted bail by a Co-ordinate Bench of this court, the petitioner is in custody since 12.11.2022 and charge sheet has already been submitted, as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Spl. Judge, N.D.P.S. Act, Rohtas at Sasaram in connection with Natwar PS Case No. 171 / 2022.
