The petitioner seeks bail in a case under Sections 395, 397 and 412 of the Indian Penal Code.
The petitioner is not named in the F.I.R. Nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of Shyam Lal Chaudhary. Three accused persons were put on T.I.P. and they have been identified by the informant but the petitioner was not put on T.I.P. During the course of trial, PW3 identified the petitioner in the dock after nine months of the occurrence. The petitioner is in jail since 13/01/2014. Single identification by PW3 and, that too, in the dock during the course of trial and on that basis the petitioner is in jail for one year and eight months. Patna High Court Cr.Misc. No.41951 of 2014 (5) dt.24-09-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ad hoc Addl. Sessions Judge 1st Katihar in Kadwa P.S. Case No. 78 of 2013 corresponding to S.T. No. 175/14.
