JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This is an application for grant of anticipatory bail in connection with Turkaulia P.S. Case No. 684 of 2018, disclosing offences under Sections 272, 273, 34 of the Indian Penal Code and Sections 30(a) and 45 of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 17 liters liquor from the house of the petitioners and the petitioners are named in the F.I.R.

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case only on the basis of suspicion. Further, they have no criminal antecedents. Heard learned A.P.P. also.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VII-cum-Special Judge, Excise, East Champaran, Motihari, in connection with Turkaulia P.S. Case No. 684 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
