The petitioner seeks bail in Gamharia P.S. Case No. 61 of 2012 registered under section 307 and other allied sections of the Indian Penal Code and 27 of the Arms Act. Ranjan Devi wife of Ranjit Yadav named four persons Ranjit YADAV, Anandi Yadav, Sunil Yadav, and Fisi Lal Yadav and alleged that they all came to her house. Anandi Yadav caught her hand and Ranjit Yadav fired which hit on her waist.

Learned counsel for the petitioner submits that Ranjit is the husband of the informant. He worked as constable in the Army. The Commanding Officer gave him certificate that on the date of occurrence Ranjit Yadav was on duty, therefore, the

Patna High Court Cr.Misc. No.41953 of 2014 (4) dt.06-02-2015 2/2 allegation of firing against Ranjit Yadav is falsified . The police also found the caser against Ranjit Yadav false. Only allegation against petitioner is that he caught hand of the informant for which the petitioner is in jail since 27.08.2014.

Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri Avinash Kumar, J.M. Ist Class, Madhepura in Camharia P.S. Case No. 61 of 2012. (Prabhat Kumar Jha, J) M.Rahman/- U T
