The petitioner apprehends his arrest in a case registered for the offence under Section 363/366A of the Indian Penal Code.

It is submitted on behalf of petitioner that the victim, in her statement recorded under Section 164 Cr.P.C., has specifically stated that petitioner has not kidnapped her, rather she herself went with him and performed marriage out of her own sweet will. The victim has also stated her age, as 19 years. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the statement of the victim recorded under Section 164 Cr.P.C., let the above named petitioner, in the

Patna High Court CR. MISC. No.8156 of 2022(2) dt.02-08-2022 2/2 event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Bidupur P.S. Case No. 402 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
