The petitioner apprehends his arrest in connection with Special Case No.5949 of 2021 arising out of Gardanibagh P.S. Case No.360 of 2021 registered for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 30(a), 34, and 36 of the Bihar Prohibition and Excise (Amendment) Act, 2018.

In view of the allegations levelled against the petitioner and in view of the antecedent of similar nature, the anticipatory bail application is not maintainable in view of the judgment of the Full Bench of this Court in the case of Ram Binay Yadav Vs. The State of Bihar reported in [2019 (2) PLJR 1089 (Full Bench)]. Accordingly, it is dismissed as not maintainable.
