JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-02-2018 This Criminal Miscellaneous has been filed for modification in the orders dated 13.12.2016 and 06.09.2017 passed in Cr. Misc. Nos. 47296 of 2016 and 20567 of 2017. Heard the learned counsel for the petitioner, the learned A.P.P. for the State as well as the learned counsel for the B.S.F.C.

On behalf of the petitioner it is submitted that the petitioner was directed to deposit the price of 4289.23 quintals of CMR within six months but the rice has been seized by the I/C Assistant District Supply Officer vide Bath P.S. Case No. 144 of 2017 and the petitioner has filed petition for release of the same and as such further six months time be granted to the petitioner to deposit the price of the said rice.

Patna High Court Cr.Misc. No.9187 of 2018 (2) dt.28-02-2018 2/2 The learned A.P.P. and the learned counsel for the B.S.F.C are present.

Under the circumstances, the order dated 06.09.2017 is modified to the extent that the petitioner Mukti Prasad Singh shall deposit the price of 4289.23 quintals of C.M.R within six months in equal installments and then after deposit adinterim bail granted shall be confirmed by the learned court below itself and in case of failure his bail shall be cancelled in accordance with the terms and conditions of the order dated 13.12.2016 and accordingly this Criminal Miscellaneous is hereby allowed.
