Learned counsel for the petitioner undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code.

Petitioner is said to have fled away from the place of occurrence when police tried to stop him. In presence of two independent witnesses, police seized loaded tempo with iron pipes, plates and poles.

It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely

He submits that the petitioner is the student of Ganesh High School. Petitioner is a driver, hence, he is not liable for the alleged offence. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

Learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances of the case and the fact that petitioner could not produce any valid paper regarding seized article and vehicle, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Bakhtiyarpur P.S. Case No. 153 of 2021.
