Case diary in the present case has been called for which has since been received.
Petitioner is in custody since 15.07.2015 in connection with Barh P.S. Case No. 272 of 2015 registered for the offences punishable under Sections 307, 324, 326/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that during the course of the investigation, it has come that it was one Gaurav Tandan, who had actually fired at the victim which resulted in injuries on his head. It is further submitted that the
Patna High Court Cr.Misc. No.45214 of 2015 (3) dt.08-02-2016 2/2 victim himself, in paragraph-86 of the case diary, supports the aforementioned situation.
Considering the period of custody of the petitioner and also this fact that in the case diary, it has come that firing has not been made by the present petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Barh P.S. Case No. 272 of 2015. (Anjana Mishra, J) SHAHZAD/- U T
