The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 307 and other sections of the Indian Penal Code.

As per the prosecution case, while the informant proceeded on his tractor towards his agricultural field, it is stated that the eighteen named accused persons including the petitioner herein came variously armed, started to abuse the informant and ordered that he should not cultivate his land. On protest, it is stated that the accused persons assaulted the informant's father as also his younger brother who subsequently died in course of treatment.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.19167 of 2021(2) dt.21-09-2021 2/2 that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. A number of other co-accused have been enlarged on bail including coaccused Ghanshyam Raut vide order dated 1.6.2020 passed in Cr. Misc. no.15215 of 2020. The petitioner is in custody since 16.9.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, grant of bail to co-accused and the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Belchhi P.S. Case no.67 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Barh.
