The petitioner seeks bail in a criminal prosecution registered under Sections 302 and 307 and some other allied offences of the Indian Penal Code.
Taking into consideration the fact that the petitioner is alleged to have committed the crime of murder with respect to two persons and further taking into consideration the fact that the case has been committed to the court of Session, this Court is not inclined to accede to the prayer made on behalf of the petitioner at this stage. Accordingly, his prayer for bail in connection with Sessions Trial No.100 of 2014, arising out of Simultalla P.S. Case No.42 of 2013, pending in the court of the learned Sessions Judge, Jamui, is rejected for the present.
The learned trial court is directed to take up the trial of the petitioner on priority basis and all endeavour shall be made to conclude the trial at an early date preferably within a period of nine months from the date of receipt/production of a copy of this order. If the trial is not concluded within the aforesaid period of
Patna High Court Cr.Misc. No.42595 of 2014 (3) dt.21-01-2015 nine months, then the petitioner shall be at liberty to renew his prayer for bail.
