JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-02-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The issue raised in the present writ application is premature. The writ petition has been filed merely on the apprehension that services of the petitioner may be terminated as she has not been able to clear the eligibility test. It appears that the issue was decided by the Apex Court in SLP© No. 38759 of 2016 that one more opportunity be provided to the teachers and the State Government has also

Patna High Court CWJC No.15272 of 2017(2) dt.25-02-2020 2/2 decide to provide one more opportunity to prove worth. Since no eligibility test was conducted, apprehension of the petitioner is totally misconceived.

The writ petition is, accordingly, dismissed as premature. As and when the cause of action arises, the petitioner may approach this Court.
