In this case, the petitioner is seeking regular bail in connection with Khadawanpur (Chhaurahi) P.S. Case No. 190 of 2019 registered for offence punishable under sections 399, 402, 414, 465, 467/34 of the Indian Penal Code and 25 (1-b) a/26/35 of the Arms Act.
The petitioner had earlier moved before this Court for regular bail in Cr. Misc. No. 79460 of 2019 and this Court, vide order dated 11.12.2019, rejected the bail of the petitioner with the observation that he may renew his prayer for bail after framing of charge or after six months in jail custody. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.11112 of 2020(2) dt.22-01-2021 2/2 petitioner is in custody since 09.09.2019.
Looking to the above observation, facts and circumstance of the case, let the petitioner above named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Begusarai in connection with Khadawanpur (Chhaurahi) P.S. Case No. 190 of 2019, subject to the condition that one of the bailors of the petitioner shall be his close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. In case of failure on two consecutive dates without any reasonable ground, the court below will have liberty to take decision in accordance with law.
