Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.

As per allegation, informant's daughter was kidnapped by the co-accused persons and later on the informant came to know that the petitioner and co-accused were involved in the kidnapping of his daughter.

The main submissions advanced by Sri Ranjit Kumar Thakur, the learned counsel appearing for the petitioner are that co-accused Kundan Kumar @ Kundan Ram has been granted

Patna High Court CR. MISC. No.7606 of 2022(3) dt.10-08-2022 2/3 bail by a bench of this court vide order passed in Cr. Misc. no. 10530 of 2022 and as per prosecution victim was recovered with co-accused Kundan Kumar, in fact, on the same date of alleged occurrence, an altercation took place between the petitioner's family and the informant and owing to that present case was lodged. Further submission is that the petitioner has clean antecedent and is languishing in jail since 21.8.2021 and investigation has been completed in respect of the petitioner. Learned APP Sri Md. Anbzarul Haque Sahara has opposed the prayer for bail.

Heard both sides and perused the FIR. So-called victim has been recovered and investigation has been completed in respect of the petitioner. Case diary goes to show that victim was recovered with co-accused Kundan Kumar and in this regard para 45 of the case diary is relevant which also shows that at the time of recovery, victim was freely walking with coaccused Kundan Kumar, petitioner is languishing in jail since 21.8.2021.

Considering these facts and mainly taking into account that similarly situated co-accused has been granted bail by a coordinate bench of this court, this court is inclined to grant bail to the petitioner. Let the petitioner be released on bail on

Patna High Court CR. MISC. No.7606 of 2022(3) dt.10-08-2022 3/3 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge VI, Vaishali at Hajipur in Gorul P.S Case No. 327 of 2021.
