Case No. 263 of 2019, registered for the offences punishable under Sections 302, 201, 120B and 34 of the Indian Penal Code. Prosecution case is that dead body of brother of the informant was found near the lane in front of Bajrangbali tample and it is alleged that his brother had love affair with the daughter of one Rajiv Kumar and earlier co-accused persons threatened his brother for the same and FIR also disclosed that petitioners have also in conspiracy killed the deceased. Submission of learned counsel for the petitioners is that except suspicion that they have conspired there is absolutely nothing against them though there is confessional
Patna High Court CR. MISC. No.6931 of 2020(3) dt.27-02-2020 2/2 statement of co-accused but there is no incriminating circumstance against them and they are in custody since 22.10.2019, having no criminal antecedent.
Heard learned APP, who could not controvert the above submission.
In view of above facts and circumstances, let petitioners be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Patna City, in connection with Nadi P.S. Case No. 263 of 2019. (Vinod Kumar Sinha, J) spal/- U T
