The petitioner apprehends arrest in a case registered for the offence punishable under sections 376,379,307/34 and other allied sections of the Indian Penal Code. Allegation against the petitioner is that he dashed the informant in the paddy field and attempted to commit rape on her.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, on the dispute of cutting paddy crops, a simple marpit took place between the parties due to which both sides sustained injuries.

Patna High Court CR. MISC. No.8806 of 2023(3) dt.26-06-2023 2/2 oppose the prayer for bail.

Considering the aforesaid facts of the case and the backdrop of the incident, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in Garhi Police Station Case No. 37 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
