JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-02-2020 The petitioner has filed the present writ petition for a direction to the respondents to grant regular promotion/time bound promotion/ACP/MACP.

Learned counsel appearing on behalf of the petitioner placed reliance on the judgments of the Apex Court in the case of the State of Bihar & Ors. Vs. Sunny Prakash: 2013(1) PLJR (SC) 233 and State of Tripura & Ors. Vs. K.K.Roy: (2004) 9 SCC 65.

Considering the aforesaid, the respondents State as well as the University are directed to verify the claim of the petitioner and appropriately decide the claim in the light of the

Patna High Court CWJC No.4254 of 2020(2) dt.27-02-2020 2/2 judgments of the Apex Court mentioned hereinabove. Necessary decision in this regard must be taken at the level of the University within a period of sixty days from the date of receipt/production of a copy of this order and thereafter the State Higher Education Department shall grant approval thereof. With the aforesaid observations and directions, the writ petition stands disposed of.
