JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The bail bond of the petitioner was cancelled on 08.11.2012 and petitioner is in jail custody since 31.07.2015. However, it is obvious from perusal of impugned order that petitioner was put on trial in Sessions Trial No. 54 of 2000 and he attended the court from the year 2000 till 2012 but it is shocking to see that even after passing of near about 12 years, the trial of the petitioner could not be concluded.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of
Patna High Court Cr.Misc. No.43994 of 2015 (2) dt.24-09-2015 2/2 Additional Sessions Judge-VIII, Saran at Chapra in connection with Sessions Trial No. 54 of 2000 arising out of Manjhi P.S. Case No. 19 of 1998.
However, the learned trial court is directed to conclude the trial of the petitioner within three months from the date of receipt/production of copy of this order. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
