JUSTICE RAKESH KUMAR ORAL ORDER 20-02-2019 Heard Sri Rajeev Kumar Singh, learned counsel for the petitioners and learned A.C. to G.A. No. 4. The present petition has been filed with a prayer to restore an interlocutory application i.e. I.A. No. 9555 of 2014 which was filed in C.W.J.C. No. 9521 of 2008 with a prayer to allowing the petitioners to implead certain persons as respondents. In the writ petition interlocutory application was
Patna High Court MJC No.357 of 2019(2) dt.20-02-2019 2/2 allowed with peremptory order on 06.03.2017. Since peremptory order was not complied with the interlocutory application I.A. No. 9555 of 2014 filed for impleading respondents nos. 13 to 37 stood dismissed. Though interlocutory application stood dismissed in the month of March, 2017 itself and writ petition thereafter was taken up on number of dates, the present restoration petition was filed on 24.01.2019 without any plausible explanation, and as such, there is no reason to entertain the present restoration petition. Accordingly, the restoration petition stands dismissed.
It goes without saying that interlocutory application i.e. I.A. No. 9555 of 2014 was not dismissed on merit. (Rakesh Kumar, J) praful/- U
