====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-02-2023 Heard learned counsel for the parties concerned. A supplementary counter affidavit has been filed on behalf of the Lalit Narayan Mithila University, respondent Nos. 3 to 5, stating therein that the revised scale payable to the petitioner has been verified by the Pay Verification Cell of the State Government and on the basis of the same, the revised pension, gratuity and other retiral dues shall be paid to the petitioner within a reasonable time frame. Learned counsel for

Patna High Court CWJC No.10142 of 2021(4) dt.25-02-2023 2/2 the University further submits that subject to the availability of the fund, the pensionary dues shall be paid to the petitioner. Mr. Apurv Kumar, learned counsel appearing for the State submits that necessary funds have been provided to the University and if any further amount is required, the University can make a requisition of the fund and, thereafter, the funds shall be released to the University.

Taking into consideration the submission made by the learned counsel appearing for the Lalit Narayan Mithila University as well as the State, the Vice Chancellor and Registrar of the University are directed to ensure payment of the retiral dues to the petitioner positively within a period of three months from the date of receipt/production of a copy of this order.

With aforesaid observation and direction, this writ application stands disposed of.
