2. The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 201/34 of the Indian Penal Code.

3. As per the prosecution case, the marriage of informant's daughter was solemnized with co-accused Manoj Sharma and from the wedlock, three children were born. It is alleged that all the accused persons named in the F.I.R. including petitioner committed murder of daughter of the informant and also cremated her dead-body without giving any information to the informant.

4. Learned counsel for the petitioner submits that petitioner has been made accused in this case merely because he happens to be younger brother of husband of the deceased. Petitioner is a government employee and posted at Bettiah and has got no concern with the affairs of deceased and her husband. Thrust of the accusation is against husband of the deceased, who is already in custody since 11.09.2024. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bettiah, West Champaran in connection with Nautan P.S. Case No. 209 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
